Healthcare Law Alert: Compliance Date for Information Blocking Rule Extended to April 5, 2021

An UPDATE to our earlier alert, The CURES Act: What New York Health Care Providers Need to Know about Compliance and Enforcement of the Federal Information Blocking Rule.

The Office of the National Coordinator for Health Information Technology (ONC) issued an Interim Final Rule on October 29, 2020 extending the compliance dates for requirements under the federal Cures Act related to information blocking and Conditions and Maintenance of Certification. ONC delayed the compliance date in recognition that elements of the health care system need to direct resources and attention to the COVID-19 public health emergency. The compliance date for the Cures Act’s information blocking rule has been extended until April 5, 2021, giving entities covered by the rule an additional 5 months to meet the requirements. The enforcement date is still uncertain.
