The National Public Employer Labor Relations Association (NPELRA) recently published a Legislative Update for its members titled “President Obama Proposes Overtime Protections to Nearly 5 Million Workers”. This communication addresses the United States Department of Labor (DOL)’s proposed changes to the current regulations under the federal Fair Labor Standards Act (Act) concerning the exemptions to overtime pay requirements under the Act. The changes include an update to the salary threshold and automatic increases to the threshold. The DOL is also considering making changes to the primary duties test.
