Thomas J. Fucillo is a partner in the Firm’s Environmental and Zoning & Land Use practice areas. He has over forty years of legal experience as a Navy Judge Advocate, a NYS Department of Environmental Conservation Regional Attorney, and in private practice.
Mr. Fucillo concentrates his practice in environmental law and land-use development and litigation issues. He has extensive experience relating to environmental enforcement and permitting, administrative legal practice before and on behalf of municipal entities, oil spill litigation, petroleum bulk storage compliance, and guiding private and municipal entities regarding compliance and litigation with respect to the State Environmental Quality Review Act (SEQRA). He also assists lenders and developers regarding environmental due diligence and has represented Class I railroads for over thirty years in all aspects of federal and state environmental legal practice.
Representative Matters
- Acting as local environmental and land use counsel for an international technology manufacturing company.
- Successfully defended a Western New York municipality in an Article 78 Special Proceeding challenging a SEQRA determination and site plan approval for a mixed-use development.
- Assisting a local development company with its mixed-use development under the State’s Brownfield Cleanup Program.
- Representing a railroad in settlement of longstanding CERCLA and Natural Resource damage claims on favorable terms.
- Representing developers in enforcement and permitting issues under New York State’s new Freshwater Wetlands regulations.
- Acting as special counsel to a Central New York municipality guiding administrative boards through the SEQRA and approval process for several large industrial and solar development projects.
- Representing a local municipality in a longstanding cleanup of a CERCLA site.
- Successfully mediated a federal action relating todenial of a variance for a cell tower site.
