On March 31, 2021, Governor Andrew Cuomo signed the Marihuana Regulation and Taxation Act (MRTA) into law. The new law expands employment protections to cover lawful consumption of recreational marijuana for adults 21 years old and older, with some important exceptions. Employers should be aware of changes to Section 201-d of the New York Labor Law and the Public Health Law. We will be discussing these changes, review obligations concerning an employee’s use of medical marijuana and provide some best practices for employers moving forward.
